By accessing or using Advertise.Network, you agree to these Terms. If you do not agree, please do not use the Platform.
1. About the Platform
Advertise.Network provides a marketplace and technology platform that connects Brands, Creators, Publishers and Vendors for advertising, marketing, production and related business opportunities.
We provide tools for discovery, campaign management, collaboration, contracts, payments and reporting.
Advertise.Network does not automatically become a party to agreements between Users unless expressly stated otherwise.
2. User Accounts
You must provide accurate and complete information when creating an account.
You are responsible for:
- Keeping your login credentials secure.
- Maintaining accurate account information.
- All activity carried out through your account.
- Ensuring that you are authorised to represent any business or organisation registered on the Platform.
We may suspend or terminate accounts containing false, misleading or unauthorised information.
3. Marketplace Listings
Brands, Creators, Publishers and Vendors are responsible for the accuracy of their profiles, listings, services, pricing, portfolios and other information submitted to the Platform.
You must not publish or offer:
- False or misleading information.
- Unlawful products or services.
- Content that infringes third-party rights.
- Fraudulent opportunities or offers.
- Content intended to deceive or harm other Users.
Advertise.Network may review, reject, modify, or remove listings that violate these Terms or applicable law.
4. Transactions Between Users
Users are responsible for agreeing on the commercial terms of their engagement, including:
- Scope of work
- Deliverables
- Pricing
- Timelines
- Revisions
- Usage rights
- Cancellation terms
- Payment terms
Users should review and confirm all applicable terms before beginning work.
Advertise.Network does not guarantee the quality, availability, performance, or suitability of any Creator, Publisher, or Vendor listed on the Platform.
5. Contracts and Approvals
The Platform may provide tools for creating, signing and managing contracts, briefs, submissions and approvals.
Users are responsible for reviewing the terms of any agreement before accepting or signing it.
Approval of a deliverable may affect the status of a Transaction where the applicable workflow provides for such functionality.
6. Payments
Where payment, invoicing, wallet or payout functionality is available, Users must provide accurate payment and billing information.
Applicable Platform fees, transaction charges or other charges will be communicated to Users where applicable.
Advertise.Network may delay, restrict or suspend a payment or payout where reasonably necessary for verification, fraud prevention, dispute resolution, legal compliance or security purposes.
7. Disputes
Users should first attempt to resolve disputes directly with the relevant party.
Where a dispute resolution process is available on the Platform, Advertise.Network may review relevant contracts, communications, submissions, approvals and transaction records.
Our involvement in a dispute does not make us a party to the underlying commercial agreement unless expressly stated.
8. Intellectual Property
Users retain ownership of content and intellectual property that they own and submit to the Platform.
By uploading content, you grant Advertise.Network the limited right to host, display, process and use that content as necessary to operate and provide the Platform.
Users must ensure that they have the necessary rights and permissions for all content they upload.
Ownership and usage rights relating to campaign deliverables should be agreed between the relevant parties.
9. Prohibited Activities
You must not:
- Use the Platform for unlawful or fraudulent activities.
- Impersonate another person or organisation.
- Provide false information.
- Infringe intellectual property or privacy rights.
- Attempt unauthorised access to the Platform or another User's account.
- Introduce malicious software or interfere with Platform security.
- Manipulate marketplace activity, reviews or performance data.
- Use the Platform to harass, abuse or threaten other Users.
- Circumvent applicable Platform processes or fees.
10. Suspension and Termination
We may suspend or terminate your account if you:
- Violate these Terms.
- Provide false or misleading information.
- Engage in fraudulent or unlawful activity.
- Create a security risk.
- Misuse the Platform.
- Fail to comply with applicable laws.
We may also restrict access to specific features where necessary to protect the Platform or its Users.
11. Disclaimer
The Platform is provided on an "as available" basis.
We aim to keep the Platform reliable and secure, but we do not guarantee that it will always be uninterrupted, error-free, or available.
Advertise.Network does not guarantee any particular campaign result, revenue, conversion, engagement, ROI or ROAS.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Advertise.Network Pvt. Ltd. shall not be liable for indirect, incidental, special or consequential losses arising from your use of the Platform or from transactions between Users.
Nothing in these Terms limits any liability that cannot legally be excluded under applicable law.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Platform, our services or applicable laws.
Updated Terms will be published on this page with a revised "Last Updated" date.
14. Governing Law
These Terms shall be governed by the laws of India.
Subject to applicable law, disputes relating to these Terms or the Platform shall be subject to the jurisdiction of the courts having appropriate jurisdiction over Advertise.Network Pvt. Ltd.
